Ben also litigates commercial and intellectual property cases in state court, federal court, and before the United States Trademark Trial and Appeal Board. Ben serves as a first-chair trial attorney in cases ranging from multi-million dollar federal litigations and intellectual property litigations to Article 78 proceedings challenging governmental determinations and other administrative proceedings.

Ben’s litigation experience includes construction disputes, real estate litigation, partnership disputes, trademark and trade dress infringement and dilution matters, disputes involving hard money lending and complicated financial agreements, as well as employment matters (both plaintiff’s and defendant’s side). Ben also helps clients avoid litigation by understanding a client’s ultimate goals and engaging in rigorous legal analysis to achieve those goals without the expense of litigation. However, when litigation is likely, Ben devises a legal strategy that best achieves his client’s goals while protecting their rights. Clients also rely on Ben to secure trademarks for them, enforce their intellectual property rights, and maintain their trademark portfolios.

Ben is a dedicated runner, skier, and car enthusiast. Before founding Rattner Law, Ben spearheaded a successful cannabis and psychedelics practice at a White Plains, New York area law firm.  Prior to joining that firm, Ben spent nearly a decade litigating high stakes business disputes at the international law firm, Proskauer Rose LLP, and two other highly-regarded boutique New York City law firms known for their aggressive litigation tactics.

Ben received his B.A. in political science from the University of Michigan (Go Blue!). He received his law degree, cum laude, from Hofstra University School of Law, where he served as a Notes and Comments Editor for the Hofstra Law Review and was a member of the Moot Court Association.

Ben was selected as a Super Lawyer for Cannabis Law (2025), an award that recognizes the top 5% of attorneys in a particular field of law.  Cannabis Law Report named Ben a Global Top 200 Cannabis Lawyer for 2024-2026. Additionally, Ben has been recognized as a 2023 Cannabis Industry Power Player by PoliticsNY and amMetro New York, and was named the Best Cannabis Lawyer in New York (2023) by Green Market Report.

He also served on the Cultivation Committee for the Cannabis Association of New York.
